ORDER

This Criminal Original Petition is filed to direct the first respondent not to harass the petitioner under the guise of enquiry on the basis of the complaint of the second respondent. 2.It is stated by the petitioner that the second respondent has lodged a complaint before the first respondent, as if the petitioner has borrowed a sum of Rs.50,000/- from the second respondent and failed to repay the same. It is further stated that the second respondent has given a false complaint due to political vendetta against the petitioner and that the second respondent, who has got a political influence, instigated the first respondent to harass the petitioner and that the petitioner is under harassment by the first respondent police to pay a sum of Rs.50,000/- to the second respondent.

3.The learned Additional Public Prosecutor, on instructions, submitted that there was no harassment, except registering the complaint as admitted by the petitioner in this petitioner. 4.The complaint filed by the second respondent against the petitioner is not in dispute and it appears to be a simple money transaction and there is no necessity to harass the petitioner. Be that as it may, even if the petitioner is required for any enquiry, the same shall be done only after issuing notice, prescribing date and time in the manner prescribed in law. https://hcservices.ecourts.gov.in/hcservices/
