Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus to forbear the 3rd Respondent from proceeding with the panel published by him vide proceedings in Ref.No.11357/PE1/2025 dated 05.02.2026 without disposing the objection submitted by the Petitioner on 27.12.2025. ORDER

The petitioner is working as a Manager (Engineering) in the respondent Milk Producers Union Ltd. He has filed this writ petition seeking a writ of mandamus, to forbear the 3rd Respondent from proceeding with the panel published vide his proceedings in Ref.No. 11357/PE1/2025 dated 05.02.2026 without disposing his objection submitted on 27.12.2025.

2. The learned counsel appearing for the petitioner submits that the petitioner is eligible to be added in the panel, however, by referring to the punishment, which was imposed on him on 12.12.2024, he was not added in the panel. According to him, the order of punishment has been 2/6

imposed against him in an erroneous manner, against which, he has preferred an appeal and the same is pending for a long period. He further submits that the currency of punishment was over as on 12.12.2025, ie. on the date of panel and therefore, he is eligible to be added in the panel, however, he was not added in the panel. Therefore, the petitioner has raised objections and filed this writ petition seeking the above relief.

The learned Standing Counsel appearing for the respondent submits that in the panel itself, a time limit has been provided for submitting objections, if any and the petitioner has not submitted his objection in time. According to him, the petitioner has suffered with the order of punishment and on the date of panel, the currency of punishment was there and therefore, he was not added in the panel. However, the learned Standing Counsel seeks some more time for getting proper instructions.

5. The petitioner claims that the currency of punishment was over as on 12.12.2025, ie. on the date of panel and therefore, he is entitled to be added in the panel. The petitioner further claims that he has also raised his objection. However, the objection has been raised beyond the period of time. The petitioner also justified that the panel has been circulated only on 24.12.2025 and therefore, he has submitted his objection on 27.12.2025.

6. Be that as it may, the respondents shall consider the objection of the petitioner and pass suitable orders on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.

7. With the above direction, this writ petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed. 23.02.2026 ogy Index : Yes / No.
