Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who is arrayed as Accused No.2, apprehends arrest at the hands of the respondent police for the offences punishable under Sections 353, 294(b) and 506(ii) IPC, in Crime No.495 of 2016, on the file of the respondent police and hence, seeks anticipatory bail.

2.The case of the prosecution is that due to wordy quarrel, the petitioner and other accused abused the de facto complainant, who is the Sub Inspector of Police, in filthy language and also threatened him with dire consequences. On complaint case has been registered for the above said offences.

3.The learned counsel for the petitioner submitted that the petitioner is an innocent and he has not committed any offence as alleged by the prosecution and his name has been falsely implicated in this case. He further submitted that the respondent police foisted a false case against him and prays for enlarging the petitioner on anticipatory bail.

4.The learned Government Advocate(Crl.side) submitted that the petitioner is a History Sheeter in H.S.No.300 of 2015 and he has involved in six previous cases and investigation is pending. https://hcservices.ecourts.gov.in/hcservices/

5.Considering the allegation that the petitioner is a History Sheeter and he is having six previous cases and investigation is pending, this Court is not inclined to enlarge the petitioner on anticipatory bail and accordingly, the Criminal Original Petition is dismissed.
