ORDER

Seeking to direct the respondents 1 and 3 particularly the 3rd respondent to take appropriate legal action on the petitioner's complaint dated 10.02.2026 in accordance with law of BNSS 2023, this criminal original petition is filed.

2. Since no adverse order is passed against the 4th respondent, notice to the 4th respondent is dispensed with.

3. The learned counsel for the petitioner submitted that the 4th respondent is a staff, who is serving as a Physician in Front Line Hospital & Research Institute, in which the petitioner is one of the shareholder. When the petitioner had frequented to the said hospital in the capacity of Shareholder, the 4th respondent had called him by caste 2/6

names. In this regard, a complaint was lodged to the 3rd respondent. However, they have turned deaf ears towards the petitioner's complaint. Hence, this petition.

4. The learned Government Advocate(Crl.Side) submitted that the petition has been obtained only through post. As per version 2.0, the police cannot register a case without receiving voter ID and Aadhar Card. The respondent police had issued summons and the petitioner was called for the enquiry. Despite the same, the petitioner has not cooperated for the enquiry.

5. Heard the learned counsel on either side and carefully perused the materials available on record.

6. In view of the fact that the 3rd respondent police is readily available for concluding the enquiry in the complaint of the petitioner dated 10.02.2026, the petitioner is directed to appear before the 3rd respondent police, on the summons already received by him from the 3rd 3/6

respondent police, on 26.02.2026. The 3rd respondent police is directed to conclude the inquiry within a period of four(4) weeks from the date of receipt of copy of this order. It is made clear that the 3rd respondent police should further call the petitioner for inquiry if necessary after 26.02.2026 only by issuance of proper summons under Section 64 BNSS.

7. With the above directions, this Criminal Original Petition stands disposed of.
