ORDER

The present application has been filed seeking to quash the FIR in Crime No.95 of 2025 on the file of the first respondent Police against the petitioner for 1/4

the offences under Sections 49, 191(2), 191(3), 61(2), 103(2) and 3(5) of BNS, 2023.

2.According to the learned counsel appearing for the petitioner, no overcharges have been alleged against him in the FIR and he has not been named as one of the accused in the FIR. However, he has been implicated based on a confession statement by another accused person. He further submitted that a false case has been foisted against the petitioner. Therefore, he sought to quash the FIR.

3.Per contra, the learned Government Advocate (Crl. Side) appearing for the first respondent Police submitted that due to the confession of the coaccused, the name of the petitioner has been implicated. Now, the investigation is going on and therefore, at this point of time, the quashing of the FIR would not arise.

4.Heard the learned counsel on either side and perused the materials available on records.

5.This Court perused the confession of A1, wherein the petitioner has been implicated as accused, though the petitioner's name has not been 2/4

mentioned in the FIR. However, the quashing of the FIR cannot be allowed, since it is a matter under investigation. After the investigation, the petitioner's role will be determined. Therefore, there are no merits in this petition. 6.With the above observations, this Criminal Original Petition stands dismissed. Consequently, the connected Criminal Miscellaneous Petition stands closed.
