PRAYER: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorari, calling for the entire records related to the impugned notice of sale of immovable property issued by the second respondent vide proceeding No.C.E.P.41/2024-2025/SF, dated 09.01.2025 and quash the same. ORDER

Seeking to set aside the impugned sale notice dated 09.01.2025, issued by the second respondent, the petitioner has filed the present Writ Petition.

2. By consent, this Writ Petition is taken up for final disposal at the admission stage itself.

3. Since no adverse orders are going to be passed against the respondents 4 to 7, notice to the respondents 4 to 7 is hereby dispensed with.

4. The learned counsel for the petitioner has admitted that the petitioner will deposit half of the demand amount within one month from today and the

remaining amount within a further period of two months.

5. Recording the above submission made by the learned counsel for the petitioner, this Court directs the petitioner to deposit half of the demand amount within one month from today and the remaining amount within a further period of two months. In the meantime, the impugned sale notice issued by the second respondent, dated 09.01.2025, shall be kept in abeyance. If the petitioner fails to deposit the amount as stated above, the second respondent is at liberty to proceed further in accordance with law.

6. With the above directions, this Writ Petition stands disposed of. There shall be no order as to costs. Consequently, connected Miscellaneous Petition is closed.
