PETITION FOR BAIL Under Section 439 of Cr.P.C. PRAYER :- For Bail in Crime No.434 of 2021 on the file of the Respondent police.
ORDER : The Court made the following order :- The petitioners/A.2 & A.3, who were arrested and remanded to judicial custody on 06.01.2022 for the offences punishable under Sections 8(c) and 22(c) of NDPS Act and Sections 20 and 30 of Arms Act, in Crime No.434 of 2021, on the file of the respondent police, seek bail.
2.The case of the prosecution is that the petitioners and others had sold the contraband and 1 kg of contraband was seized from the first accused. Hence, the complaint. https://hcservices.ecourts.gov.in/hcservices/
3.When the matter is taken up for hearing today, the learned Additional Public Prosecutor would submit that both the petitioners were detained vide order dated 13.04.2022 passed by the District Collector and District Magistrate, Ramanathapuram District. 4.Considering the gravity of the offence alleged against the petitioners and taking note of the detention order passed by the District Collector and District Magistrate, Ramanathapuram District, this Court is not inclined to grant bail to the petitioners. 5.In the result, this Criminal Original Petition is dismissed.
