ORDER

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the first respondent to dispose of the petitioner's appeal in Na.Ka.No. 6438/2022/A4 and to cancel the forged Patta No.171 standing in the name of the fourth respondent. The petitioner further seeks restoration of Patta No.5 in the name of Arulmigu Ayyanar Temple in respect of an extent of 0.33.00 Ares, situated at Pirakudi Village, Madurai South Taluk, Madurai District.

2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself.

3. Since no adverse orders are going to be passed against the fourth respondent, notice to the fourth respondent is hereby dispensed with.

4. The learned counsel for the petitioner would submit that the subject property is a temple land and that the petitioner and his agnates have been worshipping the deity of Arulmigu Ayyanar for the past five generations. However, Patta No.171 has been fraudulently created in favour of the fourth

respondent. Despite filing a statutory appeal before the first respondent to cancel the forged Patta, no effective steps have been taken to dispose of the same. Hence, the petitioner has approached this Court seeking a direction for early disposal of the appeal and for protection of the temple property.

5. The learned Special Government Pleader appearing for the respondents 1 to 3 would submit that the petitioner's appeal will be considered and appropriate orders will be passed on merits and in accordance with law within a time frame to be fixed by this Court.

6. Recording the above submission, and without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the first respondent to consider the petitioner's appeal, and pass appropriate orders on merits and in accordance with law after providing reasonable opportunity of hearing to the petitioner, the fourth respondent and any other persons, who may be affected by such decision, within a period of twelve weeks from the date of receipt of a copy of this order.
