Respondent/Complainant PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C. praying to direct the learned 1st Additional and Principal District Judge, (PCR cases), Thanjavur District to recall the NonBailable Warrant issued in S.C.No.56 of 2011 on the same day by accepting the surrender of the petitioner.

ORDER

It is an application seeking a direction to the learned IAdditional cum Principal District Judge (PCR cases), Thanjavur District, to recall the Non-Bailable Warrant issued in S.C.No.56 of 2011 on the same day by accepting the surrender of the petitioner.

2.Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) for the respondent. 3.The learned counsel for the petitioner would submit that in respect of the prime accused, the case has been ended in acquittal; there is a compromise between A3 & A4 and the defacto complainant; due to non appearance of the petitioner, NBW has been issued against him; now the petitioner wants to surrender before the Court below; and therefore, he has come up with this petition.

4.The complaint has been registered in the year 1999 and the case has been pending for more than 17 years. This pendency is because of the irresponsible conduct on the part of the petitioner/accused in not attending the Court. Under such circumstances, the direction sought for by the petitioner does not merit acceptance and accordingly, this criminal original petition is dismissed.
