RESPONDENT/COMPLAINANT Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court will be pleased to relax the condition imposed by this Honourable Court that the petitioner shall report before the Learned Special Judge, Special Court for Bomb Blasts Cases, Poonamallee, Chennai daily at 10.30 am., in all working days, until further orders in Crl.O.P.No.9549/2017 dated 24/08/2017 in Crime No.1/2018 on the file of the Respondent Police.
Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.T.LAJAPATHI ROY, Advocate for the petitioner and of M/S.M.ANANTHA DEVI, Government Advocate (Crl.Side) for the Respondent the court made the following order:- The petitioner was granted bail on 24.08.2017 in Crl.O.P(MD). No.9549 of 2017. He was directed to appear before the learned Special Judge, Special Court for Bomb Blasts Cases, Ponnamalee, Chennai daily at 10.30 a.m in all working days until further orders. 2.Thereafter, the petitioner had filed a petition in Crl.M.P (MD).No.11324 of 2017 before this Court for relaxing the condition imposed by this Court in Crl.O.P(MD).No.9549 of 2017. The said application was dismissed on 14.12.2017 on the ground of no change in circumstance.
3.The learned counsel for the petitioner submitted that the petitioner is residing at Dharmapuri. It is very difficult for him to appear before the learned Special Judge, Special Court for Bomb https://hcservices.ecourts.gov.in/hcservices/
Blasts Cases, Poonamallee, Chennai in time.
4.The learned counsel for the petitioner, on instructions, has given a specific undertaking before this Court that he will not move for further modification or relaxation of the condition imposed by this Court. This undertaking is given in view of the strong objection raised by the learned Government Advocate (Crl.Side). 6.Taking note of the objection raised by the respondent side and in view of the undertaking given by the petitioner, this Court modifies the earlier condition imposed by this Court. Accordingly, the petitioner shall appear before the learned Judicial Magistrate No.I, Dharmapuri daily at 10.30 a.m on all working days. On every Saturday and Sunday, the petitioner shall appear before the Inspector of Police, B1-Town Police Station, Dharmapuri at 10.30 a.m., until further orders.
7. With this modification, this Criminal Miscellaneous Petition is disposed of.
