ORDER : The Court made the following order :- The petitioners/A.1 and A.2, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Section 306 I.P.C., in Crime No.55 of 2021 on the file of the respondent police, seek anticipatory bail.

2. Heard the learned Counsel for the petitioner and the learned Government Advocate(Crl.Side) appearing for the State. https://hcservices.ecourts.gov.in/hcservices/

3. It is seen from the submissions that the deceased in this case was taking treatment for mental depression and it appears that

the petitioners insisted the defacto complainant and his wife to vacate the house stating that they are going to give the house on lease. When the defacto complainant demanded the advance amount, the petitioners reduced the amount for the pending rental arrears and also further reduced the amount for the stay in the house after February 2021. When the defacto complainant demanded a sum of Rs.5,000/-, the petitioners offered to pay only a sum of Rs.3,000/-. While things being so, when there was no water discharge in the pipe, the deceased requested the petitioners to switch on the motor and the first petitioner, not only refused to switch on the motor, but also scolded the deceased and tried to attack her with broomstick. Unable to bear this insult, the deceased said to have committed suicide. This First Information Report was registered only on 24.02.2021 and the investigation is in preliminary stage.

4. Considering the gravity of the offence alleged against the petitioners and also considering the fact that the investigation is in the initial stage, this Court is not inclined to grant anticipatory bail to the petitioners. Accordingly, this Criminal Original Petition is dismissed.
