Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused, apprehends arrest at the hands of the respondent police for the alleged offences punishable under Section 379 IPC and Section 3 of TNPPDL Act, in Crime No.123 of 2016 on the file of the respondent police and hence, seeks anticipatory bail.

2.The case of the prosecution is that on routine vehicle check up, the respondent Police intercepted the vehicle bearing Registration No.TN-69-AA-3933 and founds 1-1/2 units of sand without any valid permit and hence, case has been registered for the above offences.

3.The case of the petitioner is that the petitioner is an innocent person and he has committed any offence as alleged by the prosecution.

4.The learned Government Advocate (Crl.Side) submitted that five previous cases are pending against the petitioner for the https://hcservices.ecourts.gov.in/hcservices/ similar offences and investigation is pending.

5.Considering the contention of the learned Government Advocate (Criminal Side) that five previous cases are pending against the petitioner for the similar offences, this Court is not inclined to grant anticipatory bail to the petitioner and accordingly, this Criminal Original Petition is dismissed.
