Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the respondents 1 and 2 herein to re-fix the scale of pay of Rs.8825/- + Rs.100 personal pay on par with the junior of M.R.Beulah Jebalatha with effect from 02.02.2001 and pay arrears to the petitioner thereon within a time frame as may be fixed by this Court. By consent of both parties, this writ petition is taken up for final disposal at the stage of admission itself. 2.Learned Counsel for the petitioner would submit that the petitioner joined as Junior Assistant in the department of Employment and Training on 27.12.1976. Whereas, on Beulah Jebalatha, joined in the year 1987 and is junior to the petitioner. While that being so, for completing M.Phil Degree, the petitioner was granted Rs.200/- + Rs.200/-, totally Rs.400/- as per G.O.No.194 dated 10.10.2006. Whereas, the said Beulah Jebalatha was granted with Rs.275/- + Rs.275/-, totally Rs.550/-, based on the very same Government Order. W.P.[MD]No.6731 of 2021 representation on 25.09.2020. Since, the said representation has not been considered till date, the present Writ Petition came to be filed.
3.Learned Counsel for the petitioner would submit that this Court may issue a direction to the respondents to consider the petitioner's representation.
4.Accordingly, there shall be a direction to the second respondent to consider the petitioner's representation dated 25.09.2020, on its own merits and pass appropriate orders in accordance with law, after hearing the petitioner as well as Beulah Jebalatha, within a period of twelve [12] weeks from the date of receipt of a copy of this order.
5..This Writ Petition stands disposed of, with the above direction. However, there shall be no order as to costs.
