O R D E R

This writ petition has been filed to call for the records pertaining to the impugned order passed by the respondent in Na.Ka.No.05/-C4 PS/TRC/2018 dated 19.04.2018 and quash the same and consequently directing the respondent to grant permission and necessary protection to conduct cultural programme i.e., Karagattam on 27.04.2018 and Adal Padal on 28.04.2018 on the eve of Arulmigu Selvamuthu Mariamman Temple at Mill Colony, Ramji Nagar, Trichy.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader appearing for the respondent.

According to the petitioner, he made a representation to the respondent on 16.04.2018, to grant permission to conduct cultural programme i.e., Karagattam on 27.04.2018 and Adal Padal on 28.04.2018 on the eve of Arulmigu Selvamuthu Mariamman Temple at Mill Colony, Ramji Nagar, Trichy. Challenging the aforesaid order, the present writ petition has been filed.

4. The learned counsel appearing for the petitioner would submit that the impugned order has been passed without giving any opportunity to the petitioner and the petitioner also undertakes to abide by the conditions imposed by the respondent for conducting the programmes.

5. The learned Additional Government Pleader appearing for the respondent would submit that the respondent has rejected the said representation on the ground that the petitioner has made a representation to conduct the programme from 10.30 onwards.

The learned counsel appearing for the petitioner requests this Court to grant liberty to make a fresh representation indicating the schedule time up to 10.00 p.m. to conduct the Adal Padal programme. The learned Additional Government Pleader fairly submitted that if any such representation has been received, the same shall be considered in accordance with law by imposing necessary conditions.

In the light of the above said facts, the petitioner is directed to make a fresh representation indicating the schedule time up to 10.00 p.m. along with the copy of this order to the respondent and if any such application has been received, the respondent is directed to consider the said representation and pass appropriate orders, on merits and in accordance with law on or before 26.04.2018, by taking note of the order passed by this Court in W.P. (MD)No.7043 of 2018, dated 02.04.2018.

8. With the above direction, this writ petition stands disposed of. No costs.
