JUDGMENT

((Judgment of the Court was made by Dr.G.JAYACHANDRAN, J.) The respondent herein filed writ petition in WP(MD) No.28122 of 2023 being aggrieved by the suspension order dated 26.06.2023 denying permission to retire. The learned Single Judge, after considering his case with one Jothikumar, who also was facing criminal case but allowed to retire without prejudice to the interest of the department but take action subject to outcome of the criminal proceedings, allowed the writ petition by setting aside the impugned order and directing the first appellant to permit the writ petitioner to retire from service without prejudice to the criminal case and the surcharge proceedings pending against him. Being aggrieved by this order, the Joint Registrar has filed the intra- Court appeal.

2. It is brought to the notice of this Court that pending appeal, the first appellant has issued a proceedings dated 19.12.2025, wherein, the respondent/writ petitioner has been permitted to retire without prejudice to the departmental surcharge proceedings as well as criminal case. Since the respondent has been allowed to retire by the first appellant itself, nothing Page No.2 of 4
