ORDER
The Criminal Original Petition is filed for issuing a direction to the learned Judicial Magistrate No.II, Dindigul, to dispose of the case in C.C.No.441 of 2016 within a time stipulated by this Court.
2.Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.
3.The petitioner is the first accused in the criminal complaint lodged by his wife as against the petitioner and others which was registered in Crime No.26 of 2015 for the alleged offences under Sections 294(b), 120(b), 498(A) of I.P.C., and Section 4 of T.N.P.H.W. Act. After filing Charge Sheet, the case was taken on file in C.C.No.441 of 2016 by the learned Judicial Magistrate No.II, Dindigul, for the alleged offences under Sections 294(b), 354(1)(i), 498(A), 120(b) of I.P.C., and Section 4 of T.N.P.H.W. Act. 4.The petitioner states that the criminal proceedings are delayed unnecessarily as the defacto complainant and other witnesses are not co-operating. in this case are put to harassment and inconvenience because of the pendency of the criminal case.
5. Having regard to the facts and circumstances of this case, this Court is inclined to allow this petition.
6. As a result, the Criminal Original petition is allowed and the learned Judicial Magistrate No.II, Dindigul, is directed to expedite the trial in C.C.No.441 of 2016 and to dispose of the same within a period of four months from the date of receipt of a copy of this order.
