PRAYER: Civil Revision Petition under Article 227 of Constitution of India, to set aside the order dated 09.03.2022 in I.A.No.2 of 2022 in O.S.No.324 of 2016 passed by the learned II Additional Sub Judge, Tiruchirappalli.

ORDER

This Civil Revision Petition has been filed to set aside the order, dated 09.03.2022 in I.A.No.2 of 2022 in O.S.No.324 of 2016 passed by the learned II Additional Sub Judge, Tiruchirappalli. 2.The parties are referred to as per the rank mentioned before the Court below.

3.The respondent herein/plaintiff has filed a petition in I.A.No.2 of 2022 in O.S.No.324 of 2016, under Order XI Rule 14 and 16 read with Section 151 of Civil Procedure Code, for production of some documents. The said petition was allowed by the learned II Additional Subordinate Judge, Tiruchirappalli and also issued direction to the defendants to produce the documents mentioned in the affidavit. Aggrieved over the said order, the defendants are before this Court.

4. Heard on either side and perused the material documents available on record.

5.On perusal of documents, it is revealed that thirteen documents were listed in the petition. The document Nos.1, 2, 4, 9, 10, 11, 12 & 13 are must be available with the first defendant and he can produce those documents. If he has not produced those documents within 15-days from the date of receipt of copy of the order, the Court can take presumption against the first defendant. While disposing the suit in O.S.No.324 of 2016 direction given by this Court could be followed.

6.With the above observations, this Civil Revision Petition is disposed of. No Costs. Consequently, connected miscellaneous petition is closed.
