ORDER

This Criminal Original Petition has been filed to direct the learned Special Sessions Judge (PCR Court), Theni to consider the bail application of the petitioners on the same day of their surrender itself in Crime No.110/2026 on the file of 2nd respondent police.

2. Since no adverse order is passed against the 3rd respondent, notice to the 3rd respondent is dispensed with.

3. The prosecution alleges that on 15.02.2026 at about 8.00 p.m., while the 3rd respondent was watching a cricket match on his mobile phone, the petitioners and another accused allegedly attacked him with an iron rod, a wooden log, and their hands. As a result, he sustained bruises and internal injuries. It is further alleged that they abused him in filthy language, insulted him on caste lines, and criminally intimidated him. Based on the complaint lodged by the 3rd respondent, FIR in Crime No.110 of 2026 came to be registered for the offences under Sections 2/5

296(b), 115(2), 118(1), 351(3) of BNS, 2023 and Sections 3(1)(r), 3(1) (s) and 3(2)(va) of SC/ST (POA) Act, 1989 on the file of the 2nd respondent police.

4. Heard the learned counsel on either side and carefully perused the materials available on record.

5. Considering the limited scope of the relief sought for, this Court hereby direct the learned Special Sessions Judge (PCR Court), Theni, to issue prior notice to the defacto complainant and thereafter to consider the bail application of the petitioners on the same day of their surrender before that Court in connection with Crime No.110 of 2026 on the file of the 2nd respondent police.
