Prayer :- Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the respondents 1 to 4 grant compensation of Rs.50,00,000/- (Fifty lakhs) to the petitioners wife for the negligence in performing the Family Planning Operation by the 5th respondent within a time stipulated by this Honble Court and to pass such further or other orders as this Honble Court may deem fit and proper in the circumstances of the case and thus render justice.
ORDER:- This Writ Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of K.Yasar Arafath , Advocate for the Petitioner and of Mr.S,Shaji Bino, Special Government Pleader for R1 and R4 and of Mr.P.B.Ahamed Yasmin Parvin , Government Advocate for R2,3,5, this Court made the following order: When the matter is taken up for hearing, Ms.P.B.Ahamed Yasmin, learned Government Advocate appearing for the respondents 2, 3 and 5 reported that pursuant to the order of this Court dated 21.03.2025, a sum of Rs.60,000/- (Rupees Sixty Thousand only) has been paid to the wife of the writ petitioner on 11.04.2025.
This is in compliance with the order passed by this Court dated 21.03.2025. Incase the petitioner still has any grievance, it is always open to the petitioner or his wife to approach the jurisdictional civil Court seeking damages.
