This Criminal Original petition has been filed to direct the respondents 1 to 3 herein not to harass the petitioner and his family members under the guise of enquiry.

2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate(Criminal side) appearing for the respondents 1 to 3.

3.The learned counsel for the petitioner submitted that the petitioner is doing a business under the name and style of Vaideeswari Textiles. He further submitted that the petitioner has purchased dress materials to the tune of Rs.12,00,000-/ after paying the amount duly from Jain Trading Company, at Bodynayakanur, which is run by the fourth respondent. He further submitted that the fourth respondent cheated several persons and the third respondent also registered five cases against the fourth respondent. He further submitted that even though no case has been registered against the petitioner, under the guise of enquiry, the third respondent is harassing the petitioner.

4.The learned Government Advocate (Crl.side), on the contrary, contended that the third respondent has not harassed the petitioner, because, no case has been registered against the petitioner. He further submitted that only for the enquiry purpose, with regard to the case registered against the fourth respondent, the petitioner was called by the third respondent. Hence, he requests to dismiss the petition.

5.If the third respondent wants to enquire the petitioner, it is always open to the third respondent to issue summons under the Code of Criminal Procedure and thereafter to enquire him. 6.With the above observations, this Criminal Original Petition is closed.
