ORDER: This CRP coming on for hearing on this day upon perusing the petition, affidavit filed in support thereof and the record in the case and upon hearing the arguments of Mr.S.Alagarsamy, Advocate for the petitioner and of Mr.R.Aravindan, Advocate for the 2nd respondent, and this Court made the following order:- The learned counsel for the petitioner has filed a Cost Memo, dated 12.10.2015, to the effect that the conditional order, dated 08.10.2015, of this Court has been complied with.

2. This Civil Revision Petition is allowed and the order, dated 01.06.2015, passed in I.A.No. 424 of 2014 in O.S.No.306 of 2009, by the learned I Additional Sub Judge, Madurai, is set aside. I.A.No.424 of 2014 is allowed. Consequently, connected miscellaneous petition is closed.

3. The learned I Additional Sub Judge, Madurai is directed to restore the suit in O.S.No.306 of 2009 and dispose of it as expeditiously preferably within five months from the date of receipt of a copy of this Order.
