When this Court was about to dismiss this Criminal Original Petition on merits, Mr.S.C.Herold Singh, learned counsel for the petitioner sought permission of this Court to withdraw this Criminal Original Petition. He also made an endorsement to that effect.

2. Recording the same, this Criminal Original Petition is dismissed as withdrawn with a liberty to raise all the grounds made herein before the trial court. Consequently, connected Miscellaneous Petition is closed. The personal appearance of the petitioner before the trial court is dispensed with. However, he should appear before the trial court as and when his presence is required.
