Respondent/Respondent/Petitioner/Landlord PRAYER: Civil Revision Petition is filed under Section 25 of the Tamil Nadu Buildings (Lease and Rent Control) Act, 1960 to set aside the fair and executable order, dated 01.09.2014 made in R.C.A.No.31 of 2013 on the file of the Principal Sub Court, Madurai confirming the order, dated 31.07.2013 passed by the Rent Controller cum Additional District Munsif Court, Madurai in R.C.O.P.No.235 of 2009.

ORDER

The petitioner/tenant under the respondent/landlord has filed the above Civil Revision Petition challenging the fair and decreetal order passed in R.C.A.No.31 of 2013 on the file of the Principal Sub Court, Madurai and the fair and decreetal order passed in R.C.O.P.No.235 of 2009 on the file of the Rent Controller cum Additional District Munsif Court, Madurai filed under Sections 10(2), 10(3)(a)(iii) of the Tamil Nadu Buildings (Lease and Rent Control) Act, 1960.

2. Heard the learned counsel appearing for the petitioner and the learned counsel appearing for the respondent.

3. A memo of compromise is filed today ie., on 03.02.2015, signed by both the parties and counter signed by the respective Advocates.

4. As per the compromise memo, the tenant has agreed to vacate the premises on or before 30.07.2015 and hand over the vacant possession to the landlord without any hindrance and further, it is stated in the compromise memo that in view of the compromise, the Civil Revision Petition may be dismissed.

5. Recording the compromise memo, the Civil Revision Petition is disposed of accordingly. The memo of compromise shall form part of the order. No costs. Consequently, connected Miscellaneous Petition is closed.
