Respondent/Respondent PRAYER: Civil Revision Petition is filed under Article 227 of the Constitution of India to direct the Family Court, Madurai to dispose of H.M.O.P.No.135 of 2013 in accordance with law within a stipulated time fixed by this Court.

ORDER

1. As this matter lies in a narrow campus, we shall dispose of this matrimonial matter at the admission stage itself.

2. The husband/revision petitioner wants early divorce from his wife/respondent. This is the objective of this petition. He filed H.M.O.P.No.135 of 2013 in the Family Court, Madurai.

3. The Family Courts presents a woeful figure. Large number of matrimonial OPs are pending. It is an indication of increasing a number matrimonial discordance. Simply the Family Courts are being flooded with cases and crowd. It is a sickening sight before the Family Courts.

4. Among the various categories of cases, divorce cases ranks first. More number of people are waiting in cue to get divorce. The reasons are so many. If we go into that, in the end, we will be lost because the reasons are numerous with different dimensions and no homogeneity between two Family Court cases.

5. Now, in this case, it is submitted that the petitioner is put to irreparable loss, if he is not given divorce.

6. Divorce is not an item available in a provision store or in a vegetable market. Lot of deep thinking is required before granting divorce. So, fit and appropriate cases, it has to be granted. But, there is no instant divorce, even in Section 13-B of cases, there is a waiting/cooling off period is prescribed.

7. In every case in the Family Court, behind a story, behind a family https://hcservices.ecourts.gov.in/hcservices/

problem, behind quarrelling of spouses, sufferings of children, sufferings of the parents and sufferings of relatives, sufferings of permitted lawyers also, because these cases require/consume lot of their time and energy, it is not like M.C.O.P cases or civil cases. But, these matrimonial matters also have to be solved quickly because life of human beings are involved, children are involved. It is not a matter of money. It is matter of prestige.

8. In view of the foregoings, the Judge, Family Court, Madurai is directed to expeditiously dispose of H.M.O.P.No.135 of 2013 and dispose of the case at an early date by avoiding unnecessary adjournments and by eliciting fullest co-operation of both sides.

9. Accordingly, this Civil Revision Petition is disposed of. No costs.
