In this revision, Ramadoss, an injured person, who was granted compensation of Rs.14,47,448/- by the Commissioner under Workmen Compensation Act/ Deputy Commissioner for Labour, Madurai, seeks direction to the said official to disburse the amount deposited by the second respondent.
2. In this matter, as directed by this Court, notice has been given to respondents 1 and 2. Their names were also printed in today's cause list. But, neither they nor their counsel was present.
3. The learned counsel for the revision petitioner would submit that though the second respondent deposited the compensation amount, the Deputy Commissioner has no heart to disburse the same to the revision petitioner and it is being prolonged for a longtime.
4. The workman has lost both his legs. He has become a crippled. The Deputy Commissioner adjudicated the matter and awarded compensation. Accordingly, the Management deposited the compensation amount. But, the Deputy Commissioner has not taken any https://hcservices.ecourts.gov.in/hcservices/
steps to disburse the amount to the injured. In such circumstances, the Deputy Commissioner must be condemned, because, he has no business to retain the amount and giving time unless any stay order has been passed by this Court or other Courts.
5. We hope that he will realize his role as a Commissioner under Workmen Compensation Act and he will not repeat exhibiting this kind of disinterested attitude.
6. In the circumstances, the Commissioner under Workmen Compensation Act / Deputy Commissioner for Labour, Madurai, is directed to disburse the compensation amount, which was deposited by the second respondent before the said Commissioner, to the revision petitioner, forthwith.
