ORDER:- This Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.M.Karunanithi, Advocate For T.Lenin Kumar, Advocate for the Petitioner this Court made the following order:
This Writ Miscellaneous Petition has been filed to clarify the order of this Court dated 05.10.2020, passed in W.P.(MD) No.13456 of 2020.
2. According to the petitioner, the petitioner has sought for issuance of patta to the petitioner in respect of S.No.167, of an extent of 0.02.0 Ares out of 0.85.0 Ares in Manamelkudi Village, Manamelkudi Taluk, Pudukottai District and to effect the mutation of revenue records by considering the petitioner's representation dated 19.10.2019. Though this Court has granted the relief, directing the second respondent to consider the representation of the petitioner, dated 19.06.2019 and in case of granting patta to conduct survey, in view of the typographical error in paragraph Nos.1 and 3 and in the prayer mentioning the extent of land as 0.020.0 Ares instead of 0.02.0 Ares, the second respondent is refusing to take further action.
3. A glance of the order dated 05.10.2020, passed in W.P.(MD) No.13456 of 2020, would reveal that the extent of 0.02.0 Ares has been wrongly shown as 0.20.0 Ares. It is a typographical error.
4. In view of the above, this Court directs the Registry to correct the extent of land as 0.02.0 Ares instead of 0.20.0 Ares in paragraph Nos.1 and 3 and in the prayer 2/4
of the order dated 05.10.2020, passed in W.P.(MD) No.13456 of 2020, and issue fresh order copy. Since the time granted by this Court to comply with the said order has expired, this Court directs the second respondent to complete the said exercise within a period of one month from the date of receipt of a copy of this order.
5. With the above observations and directions, this Writ Miscellaneous Petition stands disposed of.
