O R D E R

This Criminal Original petition is filed for issuing a direction to the respondent Nos. 1 and 2 herein not to compel the petitioners herein to surrender original sale deeds in respect of S.No.110/6 Sirumaruthur Group, Devakottai Taluk, Sivagangai District and further direct the respondent Nos. 1 and 2 not to interfere in the civil dispute among the family members.

2. According to the petitioners, the complaint given by the third respondent is purely civil in nature and hence, the petitioners have filed this Criminal Original Petition for the above said prayer.

3. The learned Additional Public Prosecutor appearing for the respondent Nos. 1 and 2 on instructions submitted that if the 3rd

respondent and the petitioners co-operate for an enquiry, the same shall be conducted forthwith and if the complaint is found to be civil in nature, the same will be closed.

4. In view of the above submission made by the learned Additional Public Prosecutor, this Criminal Original Petition is dismissed. However, the second respondent is directed to proceed with the complaint in accordance with law. The petitioners shall appear before the second respondent Police for an enquiry on receipt of summons.
