Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners, who are arrayed as accused Nos.1 to 5, apprehends arrest at the hands of the respondent police for the offences punishable under Section 174 Cr.P.C. @ Section 306 IPC., in Crime No.20 of 2016, on the file of the respondent police and hence, seek anticipatory bail.

2.The case of the prosecution is that the petitioners quarrelled with the deceased and abused her in filthy language and attacked her and also insisted the deceased to commit suicide. Due to that, the deceased committed suicide, by hanging. On complaint, a case has been registered for the above said offences against the petitioners.

3. The case of the petitioners is that the petitioners are innocent and they have not committed any offence as alleged by the prosecution. The learned counsel for the petitioner submitted that the husband of the deceased was working in abroad and the deceased https://hcservices.ecourts.gov.in/hcservices/

was having illegal intimacy with 5th petitioner. Since, there was a family dispute between the petitioners and the defacto complainant, a false complaint has been given against the petitioners. 4.The learned Government Advocate (Crl. side) submitted that the stolen 5th petitioner was having illegal intimacy with the deceased. When the deceased refused to continue the same, the petitioners insisted her to continue her relationship. Due to which, she committed suicide and the investigation of the case is pending. The earlier petition filed by the petitioners seeking anticipatory bail was dismissed by this Court, by order, dated 10.06.2016, in Crl.O.P.(MD).No.9035 of 2016.

5.Considering the serious allegations made against the petitioners and the fact that the investigation is pending, custodial interrogation of the petitioners is required.
