O R D E R
This Criminal Original Petition has been filed to direct the 2nd respondent Police not to interfere in the civil dispute and not to harass the petitioner under the guise of the enquiry.
2.According to the petitioner, a patta in respect of Survey No. 17/1E of Neyveli Vadapathy Village, Thiruvonam Taluk, Thanjavur District was wrongly issued in the name of the petitioner. While so, the third respondent approached the petitioner to sell the property to him. In this regard the petitioner has sent a representation to the Revenue Authorities to cancel the said patta. However, the third respondent lodged a complaint before the second respondent for execution of sale deed in favour of the third respondent. Taking advantage of the same the second respondent also insisted the petitioner to execute sale deed in favour of the third respondent. Since the petitioner has no right to execute sale deed, he refused for the same. Thereafter, he sent a representation to the respondents on 17.02.2025 and the same was not considered. Hence, this petition. 3.The learned Additional Public Prosecutor appearing for the respondents 1 and 2 would submit that based on the complaint of the third
respondent they have conducted enquiry and closed the same. Only for the purpose of enquiry, they have called the petitioner. Apart from that they have not harassed the petitioner as alleged by him. 4.Considering the limited scope of the prayer sought for by the petitioner, this Court is inclined to disperse of the petition without issuing notice to the third respondent.
5.Considering the prayer sought for in this petition, recording the submission made by the learned Additional Public Prosecutor that they have closed the complaint lodged against the petitioner and not harassed the petitioner, this petition is closed.
