O R D E R

This Criminal Original Petition is filed to direct the respondent no.1 to withdraw the petitioner's complaint dated 18.02.2020 pending before respondent no.2 and entrust the same to any other officer not below the rank of Deputy Superintendent of Police for investigation of the complaint based on the petitioner's representation dated 04.03.2020 by this Court.

2. The learned counsel appearing for the petitioner would submit that the allegation made by the complainant Naveen against the petitioner is that the petitioner had encroached a small portion of government poramboke land. Based on the complaint given by one Naveen, the revenue officials demolished the portion and thereafter, the said Naveen and some other persons joined together and threatened the petitioner. In such situation, the petitioner filed a complaint before the Law Enforcing Agency on 23.11.2019. Till date, the complaint was not processed and thereafter, the petitioner made a representation dated 05.12.2019 before the first respondent but the same was not considered. Hence, the present criminal original petition has been filed.

3. The learned counsel for the petitioner would submit that it would be sufficient if the respondents consider the representation https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.O.P.[MD]No.4967 of 2020 of the petitioner dated 05.12.2019 and take appropriate action in accordance with law.

4. The learned Government Advocate (Crl.side) submits that the representation dated 05.12.2019 will be considered in the manner known to law.

5. Recording the submission made by both sides, the Criminal Original Petition stands closed.
