Respondent PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the records of the respondents in connection with the impugned order passed by the respondent in Proc.No.7123/B2/2020, dated 24.02.2020 and to quash the same and direct the respondent to reinstate the petitioner into service with all service and monetary benefits.

This petition is filed as against the order of suspension, dated 24.02.2020.

2.The petitioner, while serving as Assistant, Joint II Sub-Registrar Office, Tiunelveli, he was put in-charge of Sub Registrar, Gangaikondan Sub Registrar Office, Tirunelveli Registration District. During his tenure as in-charge of Sub Registrar, he was placed under suspension on certain charges, on 24.02.2020.

3.Today (29.11.2021), when the matter is taken up for hearing, the learned Government Advocate appearing for the respondent submits that subsequent to the order of suspension, charge memo was issued to the petitioner on 04.07.2020 and enquiry Officer was also appointed on 03.08.2020. The enquiry officer concluded the enquiry and submitted his report on 16.07.2021. Based on the enquiry report, further explanation has been sought for from the petitioner on 02.08.2021. W.P(MD)No.5769 of 2020 4.In view of the said submission made on behalf of the respondent, it appears that the enquiry itself has been concluded and therefore, there is no purpose will be served, in keeping this writ petition pending.

5.Recording the submission made by the learned Government Advocate, this Writ Petition is disposed of with a direction to the respondent, to take a decision, based on the enquiry report and further explanation submitted by the petitioner on 09.11.2021, within a period of three weeks from the date of receipt of a copy of this order. No costs.
