ORDER

This petition has been filed seeking a direction to withdraw the case in Crime No.441 of 2016 from the file of the 4th respondent and transfer the same to the file of the 5th respondent with direction to conduct further investigation, within the period that may be stipulated by this Court.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) for the respondents. https://hcservices.ecourts.gov.in/hcservices/

3. In respect of a complaint preferred by the de-facto complainant, a case has been registered in Crime No.441 of 2016 under Sections 147, 294(b), 342, 379, 448 and 506(i) IPC.

4. The learned counsel for the petitioner would submit that the petitioner herein is the Tenant in the premises for more than 50 years and the proposed accused have engaged the services of the Goondas and they have ransacked the house and in respect of which, a complaint has been given. Despite the complaint, all the accused persons are adopting the same methodology of threatening the petitioner. Therefore, the petitioner is before this Court with this petition.

4. The learned Government Advocate (Crl. Side) would submit that the case has been registered only on 24.05.2016 and few accused have been arrested and others are periodically under scanner by the respondents.

5. Recording the submission, the third respondent is directed to monitor the investigation being done by the 4th respondent and file appropriate final report before the concerned Magistrate as expeditiously as possible.

With the above direction, this Criminal Original Petition is disposed of.
