Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner apprehending arrest at the hands of the respondent police for the offence punishable under Sections 120(b), 447, 379, 434, 420, 465, 467, 468, 471 r/w 109, 114 of I.P.C. and Section 3(1) & (4) of Tamil Nadu Public Property (Prevention of Damage & Loss) Act and Sections 3(a), 4(a) and 6 of Explosive Substances Act 1908, in Crime No.240 of 2012, on the file of the respondent police, seeks anticipatory bail.
2. The learned counsel for the petitioner submitted that the petitioner is not figuring as accused originally in Crime No.240 of 2012 on the file of the respondent police but has been implicated in the final report taken on file as PRC No.22 of 2016 on the file of the learned Judicial Magistrate, Melur, Madurai District. The petitioner's employer was granted anticipatory bail by this Court in Crl.O.P.(MD) No.7199 of 2017.
3. Heard the learned Government Advocate (Criminal side).
4. Considering the facts and circumstances of this case, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate, Melur, Madurai District in https://hcservices.ecourts.gov.in/hcservices/
P.R.C.No.22 of 2016 and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. Scrupulously.
5. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
