FOR ANTICIPATORY BAIL IN CRIME NO. 30 OF 2024 ON THE FILE OF THE RESPONDENT POLICE.

ORDER : The Court Made the following order :- The petitioners, who were apprehend arrest at the hands of the respondent 1/3

police for the alleged offences under Sections 364(A), 323, 452 and 506(ii) of IPC, in Crime No.30 of 2024, on the file of the respondent police, seek anticipatory bail. 2.The case of the prosecution is that the first petitioner borrowed a sum Rs.18,00,000/- from the defacto complainant and subsequently, the defacto complainant demanded the said amount and the same was refused by the first petitioner. Thereafter, the petitioners kidnapped the defacto complainant for committing murder. However, he narrowly escaped and lodged a complaint before the respondent police. Hence the case.

3.Heard the learned counsel on either side and perused the material records of the case.

4.It appears that this is the second application for anticipatory bail and the earlier anticipatory bail application filed by the petitioners in Crl.OP(MD)No.1783 of 2024 was dismissed by this Court on 08.02.2024. Now, this application is filed by the petitioners without referring the change of circumstances to consider the case. 2/3

5.Considering the above facts and circumstances of the case and also considering the fact that there is no change in circumstances, since the dismissal of the earlier petition, this Court is not inclined to grant anticipatory bail to the petitioners.
