O R D E R

The petitioner is before this Court seeking a direction to the official respondents to revoke the electricity service connection bearing No. 055020052178, presently standing in the name of the third respondent, and to transfer the same in the name of the petitioner. 2.The said service connection pertains to the property in Survey No. 707, situated at Bommayagaundanpatti, Theni Town. The petitioner claims to have purchased the said property through a Court auction. It is further stated that the third respondent had earlier obtained a sale deed in respect of the said property, which was challenged by the petitioner in O.S. No. 5 of 2007. The said suit was decreed ex parte on 16.06.2012, declaring the sale deed executed in favour of the third respondent as null and void.

3.The third respondent challenged the said decree by filing an appeal; however, the same was dismissed on the ground of delay of 2523 days. Thereafter, the third respondent preferred C.R.P. (MD) No. 2329 of 2024 before this Court, which was also dismissed by order dated 20.01.2026. Thus, the decree passed by the trial Court has attained finality. The petitioner has also taken possession of the property through execution proceedings. It is stated that a review application has been filed by the third respondent against the said order.

4.Be that as it may, as on date, the petitioner is in possession of the property, and the sale deed in favour of the third respondent stands set aside. Therefore, the petitioner is entitled to have the electricity service connection transferred in his/her name.

5.Accordingly, this writ petition is allowed. The second respondent is directed to transfer the electricity service connection bearing No. 055020052178 in the name of the petitioner within a period of one (1) week from the date of receipt of a copy of this order. 6.It is made clear that such transfer shall be subject to the outcome of the review application filed by the third respondent.
