Respondent/Petitioner/Petitioner ( in all CRPs) Prayer: These Civil Revision Petitions are filed under Section 6 (B) of Cultivating Tenants (Protection) Act against the order in E.P.Nos.37 to 39 of 2019 in P.T.Nos.4, 5 and 8 of 2017, dated 24.12.2021 on the file of the District Revenue Court, Thanjavur. For Petitioner in all CRPs : Mr.R. Venkatesh For Respondent in all CRPs : Mr. K.R. Shivashankari COMMON ORDER These Civil Revision Petitions have been filed against the order, dated 24.12.2021 passed in E.P.Nos.37 to 38 of 2019 in P.T.Nos.4, 5 and 8 of 2017, on the file of the District Revenue Court, Thanjavur.
2. Heard the learned counsel appearing on either side and perused the materials available on record.
3. The revision petitioner is the respondent in the said P.T.Nos.4, 5 and 8 of 2017, on the file of the District Revenue Court, Thanjavur. The Thasildar, District Revenue Court, Thanjavur has passed a Judgment and decree in the said P.T.Nos.4, 5 and 8 of 2017 directing the respondent to pay the lease amount on or before 30.06.2018. The Execution Petition was filed on the basis of the decree. The revision petitioner / respondent has not filed any appeal against the decree. So, the decree is confirmed.
4. Since the petitioner is a party to the proceeding and decree, she cannot question the E.P notice. The revision petitioner also appeared through counsel and contested the proceedings. Now, in the Execution Petition delivery was ordered and effected and the https://hcservices.ecourts.gov.in/hcservices/ 1/2
C.R.P(MD).Nos.753 to 755 of 2022 order copy was also filed, nothing survives in these revisions.
5. The revision petitioner has contended that she has already paid the entire lease amount and she has also filed a memo to that effect. But, the memo is in the year of 2016 before the decree. If the facts were not considered by the revenue court they may file an appeal.
6. With the above observations, these Civil Revision Petitions are dismissed by confirming the order, dated 24.12.2021 passed in E.P.Nos.37 to 39 of 2019 in P.T.Nos.4, 5 and 8 of 2017, on the file of the District Revenue Court, Thanjavur. No costs. Consequently, the connected Miscellaneous Petitions are closed.
