PRAYER : Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondent to pass orders on the statutory application preferred by the petitioner to the respondent dated 03.12.2018 seeking eviction of unauthorized occupants in the petitioner Wakf property in S.No.455/10 and 456, Thiruvithancode village, Kanyakumari District following procedures contemplated under the Tamil Nadu Public Premises Eviction of Unauthorized occupants, 1975 within the time that may be stipulated by this Court.

ORDER

The petitioner is a member of the Thiruvithancode Muslim Jamath. He complains that the wakf property belonging to the jamath is in the hands of certain unauthorized occupants. He has given a petition dated 03.12.2018, seeking their eviction. 2.It is pointed out that the provisions of the Tamil Nadu Public Premises Eviction of Unauthorized occupants, 1975, have been extended to wakf properties also from the year 2011. The respondent is the authority competent to initiate action in this regard. 3.The learned standing counsel appearing for the respondent states that the respondent will take action based on the petitioner's statutory application dated 03.12.2018. 4.The respondent will initiate action in this regard, within a period of two months from the date of receipt of a copy of this order.

5.Accordingly, this writ petition is disposed of. No costs.
