Respondents PRAYER : Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus, calling for the records of the respondent by the impugned order dated 29.10.2018 and quash the same and consequently, directing the respondent to pay the policy amount by accepting the surrender of the petitioner's LIC's Jeevan Akshay-VI, policy No.992268235.

ORDER

The learned counsel for the writ petitioner seeks leave to withdraw this writ petition with liberty to move the Consumer Disputes Redressal Forum and he has also made an endorsement to that effect.

2.Liberty is granted to the petitioner to move the Consumer Disputes Redressal Forum.

3.The learned counsel for the petitioner informed the Court that the petitioner was constrained to file this writ petition as she is 77 years old and she desperately needs the policy amount for bearing her medical expenditure. The learned counsel would further state that he would move the Consumer Disputes Redressal Forum within a period of two weeks from the date of receipt of a copy of this order.

4.If such a complaint is filed before the Consumer Disputes Redressal Forum, the jurisdictional Forum is directed to dispose of the petitioner's complaint within a period of three months from the date of receipt of a copy of this order.

5.Accordingly, this writ petition is dismissed as withdrawn. No costs. Consequently, connected miscellaneous petition is closed.
