Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, to direct the 1st respondent to consider the petitioner's case for approval based on the proceedings of the 2nd respondent issued in Na.ka.No.297/A2/2011E dated 31.03.2011 and thereby disburse the arrears of salary with effect from her initial appointment i.e., 01.08.2008 and retirement and pensionary benefits within the time limit that may be stipulated by this Court. ORDER
The prayer sought for in this Writ Petition is for a writ of Mandamus, to direct the first respondent to consider the petitioner's case for approval based on the proceedings of the second respondent issued in Na.Ka.No.297/A2/2011E, dated 31.03.2011 and thereby disburse the arrears of salary with effect from her initial appointment i.e., from 01.08.2008 and retirement and pensionary benefits within the time limit that may be stipulated by this Court.
2.Heard Mr.G.Thalaimutharasu, learned counsel, appearing for the petitioner, and Mr.D.Muruganantham, learned Additional Government Pleader, who takes notice on behalf of the respondents. https://hcservices.ecourts.gov.in/hcservices/
By consent of both parties this Writ Petition is taken up for final disposal at the stage of admission itself.
3.The learned counsel for the petitioner submitted that though a larger relief is sought for in this Writ Petition, the petitioner is now confining with the prayer that if the representation of the petitioner, dated 08.03.2018 is directed to be considered and order to that effect is directed to be passed by the respondent, the petitioner would be satisfied. 4.I have heard the learned Additional Government Pleader, who would submit that the petitioner's representation, dated 08.03.2018 would be considered on merits and orders to that effect would be passed within the time frame to be stipulated by this Court.
5.Considering the said submissions made by the learned counsel appearing on both sides, this Writ Petition is disposed of with the following direction:- "that the first respondent is directed to consider the representation of the petitioner, dated 08.03.2018 and pass orders on merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order."
No costs.
