ORDER : The Court Made the following order :- The petitioners/A1 & 2, who apprehend arrest at the hands of the respondent police for the alleged offence punishable under Sections 406, 420, 294(b), 506(1) IPC in 1/3
Crime No.1 of 2024, on the file of the respondent Police, seek anticipatory bail. 2.The case of the prosecution is that the petitioners are running a company, namely, M/S.DBI-Digital Zatiop and Impementation Limited at Kodambakkam, Chennai and they assured that they will get a job. Believing the same, the defacto complainant and other victims gave nearly, a sum of Rs.31 Lakhs. After receiving the amount, the accused persons failed to secure any job and also refused to return the money. Hence, the complaint.
3.The learned Additional Public Prosecutor appearing for the respondent police would submit that nearly Rs.31 Lakhs was received by the accused persons from the 16 victims for the purpose of arranging job. Thereafter, the accused persons failed to arrange any job. He would further submit that yet another case was also registered as against the petitioners in the Flower Bazaar Police Station, Chennai, which is also similar in nature. Therefore, he strongly objected to grant anticipatory bail to the petitioners.
4.On 11.03.2024, when the matter was taken up for hearing, no one appeared on behalf of the petitioners and hence, today, this matter is listed under the caption "For Dismissal". Even today, the learned counsel appearing for the petitioners is not ready to argue the case.
5.Considering the above facts and considering the fact that the allegations 2/3
levelled as against the petitioners are serious in nature and also considering the fact that a similar case was also registered as against the petitioners in the Flower Bazaar Police Station, this Court is not inclined to grant anticipatory bail to the petitioners.
