ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl. Side) appearing for the respondent Police.

2.The learned counsel appearing for the petitioner would submit that he is never driver of the JCB, a false case has been foisted against him, as if co-accused gave a confession statement and he has unnamed in the FIR.

3.The learned Government Advocate (Crl.Side) appearing for the respondent Police would submit that there are five accused in this case. A1 and A2 have alleged offences under Section 379 of IPC r/w Section 21(1) of the Mines and Minerals Act and from the scene of occurrence, the respondent police have seized the lorry. He would further submit that JCB operator and A1 and A2 are arrested and A3 is still at large.

CRL OP(MD). No.5018 of 2020 4.Considering the submission made by the learned Government Advocate (Crl. Side) and five units of river sand have been seized along with lorry and JCB and the the investigation is at the preliminary stage, this Court is not inclined to grant anticipatory bail to the petitioner.
