PRAYER : Writ Petition is filed under Article 226 of Constitution of India, to issue a writ of Mandamus directing the respondents to pay the Service Surrender Leave Salary of Rs.45,236/- payable to the petitioner for the period from 2010 to 2012 together with 18% interest from the date of his retirement i.e. 30.06.2016 to till the date of payment and all other attendant benefits to him within the stipulated period as fixed by this Court.
For Petitioner in both petitions : Mr.A.Rahul For Respondents in both respondents : Mr.A.P.Muthupandi Standing Counsel COMMON ORDER Heard the learned Counsel appearing for the petitioners and the learned Standing Counsel, who takes notice for the respondents. By consent, the writ petitions are taken up for final disposal at the admission stage itself.
2. The learned Counsel for the petitioners submitted that the petitioners were employed as Assistant Manager and Senior Superintendent respectively in the respondent Corporation. They retired from service on 31.05.2016 and 30.06.2016 respectively and their service surrender leave salary is yet to be disbursed. Hence, these writ petitions.
3. The learned Counsel appearing for the respondents fairly submitted that the respondents would consider the claim of the petitioners within a time frame to be fixed by this Court.
4. Having regard to the submissions made by the learned Counsel on either side and considering the fact that the petitioners were retired from service as early as on 31.05.2016 and 30.06.2016 respectively, the respondents are directed to disburse the surrender leave salary to the petitioners, within a period of eight weeks from the date of receipt of a copy of this order.
5. The Writ Petitions are disposed of with the above direction. No costs.
