PETITION FOR ANTICIPATORY BAIL Under Section 438 of Cr.P.C. PRAYER :- For Anticipatory Bail in Crime No.6 of 2021 on the file of the Respondent police.

ORDER : The Court made the following order :- The petitioner/accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 13, 14(1), 15(1) and 15(2) of Protection of child from Sexual Offences Act, 2012, and Section 67B of Information Technology Act, 2000, in Crime No.6 of 2021, on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner downloaded obscene porn videos in his mobile phone and uploaded the same in the Facebook. Hence, the complaint.

3.The learned counsel for the petitioner would submit that the petitioner is innocent and he has not committed any offence as alleged by the prosecution.

4.The learned Additional Public Prosecutor would submit that in pursuance of the report received from the National Center for Missing Exploited Children (NCMEC), the above complaint came to be registered.

CRL OP(MD). No.5757 of 2022 5.According to the prosecution, the petitioner has uploaded the child pornography.

6.Considering the seriousness and gravity of the offence alleged against the petitioner and also the fact that investigation is pending, this Court is not inclined to grant anticipatory bail to the petitioner.
