ORDER
This Criminal Original Petition has been filed seeking orders to transfer the investigation of the case in Crime No.1263 of 2022 on the file of the fifth respondent herein and entrust the same to the sixth respondent herein or some other unbiased investigating agency.
2.The learned counsel appearing for the petitioner submitted that The petitioner/de facto complainant lodged a complaint before the fifth respondent regarding the theft of 32 sovereigns of gold during her travel from Karaikudi to Thanjavur, pursuant to which an FIR in Crime No.1263 of 2022, dated 17.11.2022, came to be registered for the offence under Section 379 IPC. However, there is no progress. Hence, this petition. 3.The learned Government Advocate (Criminal side) submitted that the travel was not a single journey but consisted of multiple stages, commencing 2/6
from Muppaiyoor to Sivagangai, Sivagangai to Pudukkottai, Pudukkottai to Thanjavur, and from Thanjavur New Bus Stand to Burma Colony. In total, the petitioner travelled for about 41⁄2 hours, and during the course of such travel, she lodged a complaint stating that the jewels had gone missing. 4.The learned counsel appearing for the petitioner categorically denied the contention of the learned Government Advocate (Criminal Side), stating that the sequence of travel is clearly mentioned in the First Information Report and that the petitioner had travelled in a single slot in a single bus from Sivagangai to Thanjavur. It was further submitted that CCTV footage available at the nearby bus stand, which could have provided clues to identify the unknown accused, was duly furnished by the petitioner before the Investigating Officer.
It was also pointed out that, in another crime, the said accused was arrested, but the petitioner's jewels were not recovered. Despite the availability of such material information, the second respondent has remained inactive in the investigation and that there is no progress. Hence, the petitioner has sought transfer of the investigation.
5.Heard the learned counsel on either side and this Court has clearly gone through the records submitted by the petitioner. 3/6
6. Despite all the materials having been handed over to the fifth respondent in the year 2022, there has been no progress in the investigation. In the presence of CCTV footage and the identification of the accused in another crime, I do not find any difficulty for the fifth respondent to interrogate the said person with respect to the present crime.

Hence, the Inspector of Police, Thanjavur Taluk Police Station/5th respondent is directed to conclude the investigation within a period of three months and also apprise the progress of the investigation every Friday to the Inspector General of Police, Tricy Range/second respondent Police. The Inspector General of Police/second respondent is directed to monitor the same. 8.With the above directions, the Criminal Original Petition is disposed of. 30.01.2026 NCC : Yes / No Index : Yes / No Internet : Yes / No das 4/6
