Respondents PRAYER: Writ Petition under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, to call for the records pertaining to the impugned order on the file of the respondent No.3 dated 07.01.2022 in Na.Ka.No.A5/27441/310/2020 and quash the same as illegal and consequently, direct the respondents to select the petitioner for the post of Grade II Police Constable, with effect from the date of original selection within the time period stipulated by this Court.

ORDER

The order of rejection rejecting the candidature of the writ petitioner for selection to the post of Grade-II Police Constable is under challenge in the writ petition.

W.P.(MD)No.5538 of 2022 2.The petitioner participated in the process of selection for recruitment to the post of Grade-II Police Constable. He was successfully in the written examination and allowed to participate in the physical verification test and endurance test. During the Certificate Verification, the Selection Committee found that the petitioner has involved in criminal case in Crime No.36 of 2015 for the offence under Sections 147, 148, 294(b), 323, 324 and 307 IPC and Section 4 of TNPWH Act. During the relevant point of time, when the petitioner submitted an application, the said criminal case was pending. By suppressing the fact that a criminal case was pending against the writ petitioner, he has participated in the process of selection. Therefore, the candidature of the writ petitioner was rejected, in view of the Special Rules in force. 3.Therefore, this Court is of the opinion that there is no reason to interfere with the order of rejection. Hence, this writ petition is dismissed. No costs. Consequently, connected miscellaneous petition is closed.
