Respondents PRAYER: Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, to direct the respondent herein to renew and reissue the passport of the petitioner vide Application No.MD1071540364118, considering the place of birth of the petitioner as Adhiramapattinam, in accordance with law, considering the previous two passports issued in No.V650632 and No.H4334282 and considering the evidence recorded before the Judicial Magistrate No.1, Ramanathapuram forthwith.

Heard the learned counsel on either side.

2. The respondent issued a communication dated 30.11.2018 calling upon the petitioner to furnish proper explanation with regard to the observations made in the said communication. Without responding to the said communication, the petitioner has straight away rushed to this Court.

3. When the matter was taken up for hearing, the learned counsel for the respondent submitted that the petitioner had obtained a Passport from Trichy Passport Office in the year 1996 and without disclosing the same he had obtained a fresh passport from the respondents. Therefore, the respondent has called upon the petitioner to offer his explanation.

4. I am of the view that the petitioner must submit to the respondent and offer his explanation with regard to the circumstances in which he came to get two passports. There is no question of granting any relief at this stage. The petitioner will have to necessarily go before the respondent. This writ petition is dismissed accordingly.No costs. Consequently connected miscellaneous petition is closed.
