Respondent PRAYER: Writ Petition is filed under Article 226 of Constitution of India for issuance of Writ of Mandamus directing the respondent to refund the advance amount and rent deposited to a sum of Rs.55,101/- along with interest at 18% per annum from the date of petitioner's deposit till refund to the petitioner based on the representation, dated 08.03.2017 within time frame to be fixed by this Court. Heard the learned counsel on either side.

2.The writ petitioner was the highest bidder for a shop belonging to the respondent panchayat. But, then the shop was never handed over to the writ petitioner. Hence, the writ petitioner moved this Court in this regard.

3.The petitioner now wants the EMD paid by him and one month rent which comes Rs.55,101/- with interest. The liability of the respondent to return the said amount cannot be disputed. Therefore, https://hcservices.ecourts.gov.in/hcservices/ the respondent is directed to return the said amount of Rs.55,101/-

paid by the writ petitioner together with interest at the rate of 6% per annum from the date of deposit till the date of realization. 4.With the above terms, this writ petition is allowed.
