This Writ Petition has been filed seeking issuance of a Writ of Certiorari to call for the records pertaining to the impugned proceedings of the second respondent in Ni.Mu.No.E-2437802/2024/G5 dated 17.12.2025 and quash the same as being illegal.
2. The learned counsel for the petitioner would submit that the petitioner purchased the land measuring an extent of 3 acres and 71 cents from one Sunilkumar Jailan @ Julian Jailan on 07.05.2024. After obtaining DTCP approval, the petitioner sold certain plots and is in possession and enjoyment of the remaining unsold plots. Meanwhile, the fifth respondent filed a petition before the second respondent stating that the property belongs to his grandmother, who had executed a Settlement Deed in his favour and prayed for rectification of the UDR error and issuance of patta in his name as well as in the name of his mother. The second respondent, without conducting a proper enquiry and without Page No. 2 of 5
issuing notice to the petitioner and other purchasers and pattadars, passed the impugned order cancelling the patta issued in the names of others and directing issuance of patta in the names of the previous pattadars in Patta No.115.
3. The learned Government Advocate appearing for the first to fourth respondents would fairly submit that the records do not disclose that the petitioner was put on notice before the impugned order was passed.
4. Once a patta is transferred or restored to its original position, notice ought to have been issued to the other pattadars and interested parties. Any transfer or restoration effected without issuing notice and conducting a proper enquiry is illegal and violative of the principles of natural justice. Since no notice was served on the petitioner, on that ground alone, the impugned order is set aside and the matter is remitted back to the second respondent to pass a fresh order after issuing notice to the petitioner and other pattadars and interested parties and conducting an enquiry, within a period of sixteen (16) weeks from the date of receipt of a copy of this order.
