Respondents PRAYER: Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, to direct the first respondent to permit the petitioner to commence and complete the work of removal of Seemaikaruvel Trees from the 1993, Keela Kodumalur Kanmoi Thottam within a period of 3 months in compliance of the proceedings of the first respondent dated 20.01.2016.

ORDER

Heard the learned counsel on either side.

2. The petitioner was given the work of removal of Seemaikaruvelai trees from the petition mentioned land. However he could not complete the work within time. He wanted extension. He was directed to pay a sum of Rs.5,166/-. The petitioner failed to remit that said amount. Therefore, the first respondent issued communication dated 04.07.2018 proposing to forfeit the EMD amount of Rs.52,000/-.

3. It is seen that the second respondent has since remitted the said amount to the first respondent. The petitioner has also given a representation dated 21.07.2018 seeking permission to remove the Seemaikaruvelai trees.

4. The first respondent is directed to pass orders on the representation dated 21.07.2018 seeking extension of time to remove the Seemaikaruvelai trees. The said order shall be passed within a period of four weeks from the date of receipt of a copy of this order.

5. With the above direction, this writ petition is disposed of. No costs.
