Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records relating to the first respondent in his proceedings X.K.vz;. 00067/fgp1/1/2022, dated 20.12.2022 and quash the same and further direct the first respondent to remit the medical reimbursement amount by the petitioner. ORDER

Heard the learned counsel on either side.

2. The petitioner is a retired employee. He is a member of the Tamil Nadu New Health Insurance Scheme. The petitioner's wife underwent treatment for renal issues. The petitioner had incurred a sum of Rs.1,67,000/- for her medical treatment. Claiming reimbursement, the petitioner submitted a claim before the second respondent. The second respondent rejected the petitioner's claim. Aggrieved by the same, the petitioner filed an appeal before the first respondent. It appears that the committee under the Tamil Nadu Medical Attendance Rules recommended the petitioner's claim. In terms thereof, the first respondent passed order dated 20.12.2022 relegating the 2/4

petitioner to move the second respondent. The petitioner had resubmitted her claim before the second respondent. The second respondent in turn forwarded the same to the fourth respondent.

3. The fourth respondent is directed to process the claim and pay the eligible amount to the petitioner herein. This shall be done within a period of twelve weeks from the date of receipt of a copy of this order. I consciously refrain from quantifying what is the eligible amount.
